Can i remain in the states

if i entered the country legally in 2006 on a j1 visa and i want to marry a us citizen who serves in the military can i do this? also when we are married can i remain in the states while the papers are being processed? what are my options?

  1. You should be able to as long as you're not subject to the 212e 2 year residency requirement. It will be marked on your J visa and your DS-2019. If you are subject to the residency requirement, you'll need to apply for a waiver through the Department of State. Check out the non-immigrant visa section for instructions. If you get the waiver you'll be able to adjust to immigrant status. Your husband will need to file an I-130 immigrant visa petition, an I-485 adjustment of status form and an I-797 work authorization request and other forms. Check out uscis.gov for more information and down-loadable forms.


  2. No.  Get out.  Seriously -- we've all had enough.  If you're such a great person, you should do the right thing.

  3. If you're still in J1 status you can stay. Don't marry an American and try to adjust your status, they will just kick you out. Go home and have your  other half file a K1 petition for you. This will allow you entry into the States after which you will have 90 days to get married. Or, you could get married in you home country and have your spouse file a K3. Either of these take about a year to come through.
