Can i return a motorcycle that i just purchased 2 days ago?

I purchased my bike 2 days ago, used. It is a 2006 Ducati Superbike 749, the bike only has 2500 miles on it at the time of purchase, i have put maybe 70 miles on it since then. After driving the bike for the last 2 days ive noticed the bike gets INCREDIBLY hot. So hot to the point where its actually burning my leg on the inside, and the heat rising up from the engine actually scolds the inside of my thighs. I absolutely cannot drive this bike anymore, its just too much to handle. Ive owned 4 bikes, and ive never dealt with anything like this before. Is there some type of "clause" or something that allows a buyer to return a used vehicle after all the paperwork is already signed?

  1. If you bought it from a dealer, you have 30 days to return it. If you bought from a private party, probably not, but by law, you have 3 days to return it.Providing you signed a contract for it or a title or such documentation.


  2. No. Vehicle sales are final, which includes motorcycles. No clause or right to cancel.

  3. No, incorrect. There is no "buyer's remorse" clause on vehicle purchases. Very common misconception on here. There is no 30-day return policy unless the dealer specifically says so. There is no 3-day return policy on either dealer purchases or private party purchases.

    Once you signed paperwork and took delivery, the bike became yours.

    I've known quite a few Ducati owners, and although some complain that they run hot, none have ever complained that they run THAT hot. That issue sounds serious. I would have the dealer check it out immediately.

    If you purchased from a dealer, they may have offered a 30 day WARRANTY through them (and only them). If they didn't, you're SOL. Sell it on your own. Because unless the dealer specified in your terms of sale that you have a certain amount of time to return the bike (highly unlikely), then you've got no recourse there.

    If you purchased from a private party, forget it. If you didn't test drive it first and notice it then, you're stuck. You can't really legally blame the seller in that case.

    Bottom line: there is NO "cooling off period" or any sort of return period unless explicitly specified by the dealer. If they didn't mention it, it doesn't exist. Sorry.
