Can i sue British airways for mishandling my luggage?

British Airways the company i was travelling with gave wrongly my Bag to another passenger from Span Air when he presented to them his baggage Tag which had been lost a day earlier.They told me to wait until he may come back. They should have checked the name before giving it to him in the first place.Had the passenger took my baggage by himself , this could have been a mistake but a British Airways's agent reputedly trained staff giving it to another passenger from another flight which arrived a day earlier than mine is really a mishandling situation.The bag returned 6 days later, half loaded, through these 6 days i was stressed by the silent attitude of British Airways. Can I sue them for their reckless baggage mishandling and for the stress they caused to me? Please need advice.I am still angry at them .thank u

It doens't sound like you really understand the concept of suing someone.  This process was not set up so that people could get revenge over minor inconveniences.  You would have to show that they were negligent in their actions, and that they caused you financial harm.  Then you'd need to find a lawyer willing to take your case, and wait 2-3 years while it gets through the legal system.  Does that sound like fun to you?

    Write them a well written and detailed complaint letter and ask for a reasonable compensation.  That will yield much better results than suing them.  


  2. Start by making a formal complaint in form of a letter to their customer services. Wait and see what answer you get from them.

    If nothing happens by doing that, or you're not please with the offer you get from them, then contact a consumer protection organisation in your country. They can often help you file a complaint for you and give you advice from previous similar incidents.

    This will probably get you further with less stress than going through the whole process of suing them.

    The first point you should consider is however, what is the extent of your financial loss. If you have lost less than $200 or so, then it may not be worth suing them. It might be better to just complain about it to them and asking compensation.

    Regardless of what other know-it-alls have posted, you can sue someone if you have the financial capacity to do so. The system is made such that financial power always wins, and BA should be taught a lesson IF you can sustain the drain on your financial resources and time. They did release the baggage to another person, and that is the classic definition of negligence: as they were negligent with your belongings which they released to a third party. This is DISTINCTLY different than a luggage getting delayed and then being delivered to you.

    The snooty BA should be sued in this case, but the sad thing is that almost all people decide not to sue as they do not want the 'fun' of paying a lawyer and spending their time in going after big corporations like BA. Well, that is how the big corporations get the guts to mistreat you next time you are on a plane and again lose your luggage.

  4. You can sue anybody for anything in our modern timed. Doesn't mean it will do you any good.

  5. I'm not sure if you can sue them, but you can complain to them, and I am sure they may offer some compensation. I know most airlines have it in their terms and conditions.
