Can i sue a credit card company for harassing me for a debt already paid?

when i contacted them by post they were to ring me back but no one has rang back

  1. I can't really give you a decent answer because you don't say how they are harassing you.  Please post some specifics.

    But in general, no you can't sue the credit card company.  Most of the debt harassment laws fall under the Fair Debt Collections Act, and that law only covers collection agencies or 3rd party collectors.  The original creditor can do just about anything they want.

    If the "harassment" involves posting on your credit report you do have some options.  Again, I need more info.

I don't know - but I would start by calling the credit card company and ask about this debt.  If their records show that it has been paid, then you can tell them to call off the dogs, or you will be speaking with your lawyer.  Let them draw their own conclusions about what could happen.  Oh - and you can also let them know that you would be calling the press to let the public know how this credit card company does business.

First call them again and speak to the head of the collection department, tell them, fax them, or send them the information that this debt has been resolved.  Get the persons name that you spoke with date time etc., ask them to send you a confirmation that this debt is paid.  Tell them to make sure that their people don't call you anymore, or anyone else about this debt.  Wait and see what happens.  If this doesn't happen you can go to your next plan of attack, report them to the better business bureau, find out what state they are in , and file a claim in court, but first send them a certified letter stating that you will seek legal help if they continue to harass, and come after you about a debt that you have already paid.  Tell them this is causing grief etc., make sure you get a name to send it to/care of, and signature confirmation.  Believe me this will get their attention, and they will respond.  If they don't respond from this sue.  It can be done, and you can win.  I saw an article on line and you can do your homework first, via Google, Yahoo answer.  Do  your homework first as I said.

  6. It's not harassing unless they're doing it on purpose.  It's probably just a mistake.  Send them a letter with a copy of whatever you have that shows it's paid.

  8. Sure you can if you have the time and money to sue. Otherwise I suggest you speak to someone from the credit card company directly by phone. Usually these type of phone calls are recorded which you can use as evidence in the near future if you should decide to sue.
