Can i sue gmc?

i got into a car accident yesterday. i ran into the back of a pick up truck because he came to a complete stop and i wasnt paying attention. i slammed into him going about 50 and i have a gmc envoy and the front is totally smashed in. i hit very hard but thankfully no injuries. the only thing is my airbag never deployed and people are telling me i might have a case against gmc. should i talk to a lawyer about sueing? i would not be suing for inuries, but for having a malfunctioning vehicle thats not safe. ive seen airbags go off because somone kicked the car. what do u think?

  1. How about something else: Learn to drive. It'll help your saftey a lot more then an airbag.

  3. Technically you can sue but i wouldnt.. Chances are you are gunna lose more money on a lawyer and may not win =/

    The first thing you learn in law school is that anybody can sue anybody else for any reason - in America.

    The second lesson you learn is that - that does NOT mean you can win.

    When you sue, you sue for damages AND/OR pain and suffering.  You have none of the above.  

    You can still sue.  But individually, you will have such a battle because GMC will not let to go easily.

  5. Normally, what you should do first is work with your insurance company.

    That's your advocate.

    If the insurance company feels the automaker is at fault, there is a process called subrogation where the insurance company goes to the manufacturer.

    The insurance company has an interest in finding out who is liable for the accident.

    They also want to know why the accident happened.

    Occasionally, the manufacturer will meet with the customer and the customers insurance company involved in unusual accident.

    They do not do accident investigation, but they will discuss proper airbag deployment.

    You also need to take pictures of everything and in the meantime do not get the car fixed until you have heard back from the manufacturer.

  6. I suggest doing some online research to find out if there have been other cases won against GM on this issue -- before you spend money on a lawyer. Perhaps there is a class action suit you can join, which wouldn't cost you anything.

    I'm sure GM's lawyers have seen this same issue many times and probably have a bulletproof defense, but maybe not. It's certainly worth looking into.

    Next you'll be asking to sue Yahoo for all that time you lost asking this silly question.

  8. i forwarded this for you to the gmc/chevy corprate office. as u stated here u and no one else was injuried there for the car was safe. you have no claim and gmc's legal fee's will be handed over to you. hope ur wealthy because their lawyers arent going to be cheap.  50mph and no injures ... how do u sue for unsafe. proved there case for them in this question. good job.

  9. I don't know but I am very sorry to hear that and you are very lucky to have no injuries. Calling them would be pointless, because they would just be rude to you and tell you it is your fault. American cars aren't the best. If you need a car that is safe and reliable, look at Toyotas. Envoys are very nice, but after that happened I wouldn't trust another GM vehicle to protect you. Most Toyotas have 7 airbags standard, and they deploy. Hyundai has the same problem that your Envoy, the airbags don't work.

  10. I pretty sure you WILL find a lawyer who will take your case, BUT I wouldn't worry about it.  You had on your seatbelt and you apparently are okay.  I would worry about the other individual suing YOU.

    The other thing is that airbags are deployed when the sensor is activiated.  You MAY have just hit the person without activiating your sensor.

  11. You can only sue if there are damages. Since there were no damages there would be nothing for you to recover in a lawsuit.

  12. Just as brakes aren't guaranteed to stop your car in every situation, I don't believe airbags are guranteed to go off in any situation when they might be needed.  Perhaps your accident damaged the trigger mechanism before it could fire.

    Since you weren't injured, you should be glad it didn't go off, as it would cost you over $1K to get it replaced.  If the vehicle is totaled, you're just trying to get money even though the wreck was your fault.  If it is not totaled, and it's under warranty, your dealer will test and replace the airbag if required at no charge to you.

    Since you hit someone going at such a rate of speed, though, if the other person's vehicle damage or personal injuries exceed the maximum payout on your insurance, you will get sued and have to pay the difference.

  14. wow no wonder america is so hated? are you serious you are in a vehicle and you hit someone going 50 mph and you are OKAY and you want to sue them? be lucky you are alive jesus christ! honestly iam taking a screen shot of this page and sending it to GM cause i would love for you to try and sue them when you hit someone cause you where not paying attention while driving a huge truck? do you know how irresponsible you are that car is a weapon!

    and then lets not mention the fact modern vehicles sometimes dont deply airbags if the collission does not necessitate one
