Can i sue my Car insurence?

Does anyone know if i can do anything to make my insurers sort my claim out?

this is what happened....

I pulled in to a space to give way to an oncoming vehicle as (on a small normal street/road), there wasnt enough space for both vehicles to drive without one pulling in. So i pulled in and was stationary waiting for the vehicle to pass when a car from behind (who must of thought i was parked and didnt see the oncoming car) had to pull in quickly as he didnt see the oncoming vehicle and hit the driver side back wing off my car.

The guy was in a EDF company van, He is disputing the claim saying i reversed in to him. the cost of repair to my car is 700 pounds and there is no damage to his van. My insurence is not doing much sort this out and have already took my 2years no claims and are over charging me 2000 pound a year until the claim is settled.

Can i sue or do anything to my insurence as they are taking so long. I made the claim on the 23rd of febuary 2008.

  1. i work for an insurance broker. this type of thing is pretty commen. you will lose your no claims until the claim is settled in your favour. its just bad luck it has happened over your renewal date. if your insurers make a recovery, they will reimburse you the extra you have paid and reinstate your bonus. THAT SAID ....ring your insurers. speak to the claims handler and ask them do they think this will be settled as a fault or nonfault. if you speak to someone who isnt afraid to do a days work, and they are certain of a recovery, they can/should speak to the underwriting or renewals team and get them to reinstate your bonus and quote you the correct premium. if you need any further help let me know


  2. u need as much infoto put to the insurance as possable...drawings showing the postions etc...any whitnesses?....go higher than the insurance company...

  3. NO.  You made a claim so what gives you the right to think that they shouldn't  take away your NO CLAIMS BONUS?

    It will get sorted out but it takes time, are there any witnesses?

    4 Months is not a long time to get a claim sorted out.  Some can take years.

    If the claim is agreed in your favour you'll get your no claims bonus back.

    By the way, do you have an excess on your policy, because you won't get that back unless the other parties insurance admit fault.

  5. You should contact the ombudsman. The dispute procedure is in small print at the end of your policy.

  6. your insurance company will be dealing with the claim,after all its in their interest to proove it wasnt your fault!

    they will be in the processes of getting the othe other people to admit it was their fault

    if you have legal cover on your policy let your insurance company know your happy for them to take the other company to court if they need to.

    they delay in you claim will be the other company not yours, they will have set procdures that they have to follow when dealing with liability issues.

    unfortunately these type of claims do take a long time but just be patient as you will get back your no claims, they will refund any extra monies you have had to pay and they will recover monies from the other company.

    so i would say dont sue your company , work with them and hopefully the guy in the van and his company will soon admit its their fault. good luck
