Can i sue my insurance company for not paying out?

No. It's called rejecting a claim for something that is not covered by the policy.

Was it for a covered loss per your insurance policy (contract) or was it excluded?  Were you investigated for fraud?  If it was a covered loss per your policy and you were not paid, then you can report the company to the State Insurance Dept for a bad faith claim.  They have to respond to the complaint in a certain amount of days with an answer to why they didn't pay & if it was not a legitimate reason, your claim should be paid, less your deductible.

You can sue anyone for anything.  Winning your case is another thing.  They may have a valid reason.
