Can i sue my insurance company if they specifically told me not to make a payment and cancelled my policy?

I was specifically told NoT to pay my monthly payment because i was going to have another policy issued to me. Prior to the NEW policy being enstated i crashed. I have not paid my policy, i have no up to date coverage, and they are saying that i'm on my own. The person I hit has liability and uninsured motorist coverage.

  1. The insurance company is right.  your responable for you to have insurance not the company.


  2. Unless you have it in writing from them, forget it.  This is why business should never be conducted via phone call.

  3. if you have it in writing from your insurance company not to pay then you might have a shot.

    If they told you over the phone....basically look at it like this, you might be able to find a lawyer....they have a department of lawyers...

  4. You can certainly sue them.... will you win is the question. If they documented that in the notes on your file you might be able to win. Also if you made any type of payment for the new policy that would be helpful.... Did they issue insurance cards?  More than likely this becomes a he said she said situation and likely will end not in your favor. Sorry about that.

  5. I think you need to obtain all paperwork regarding this issue and create a timeline.  If you are the one who is right, dates will be your friend and prove that you should be/have been covered.
