Can i sue them for destrying it?

I live with my sister and her husband in order to care for our disabled parents. My sister has a pc that when she purchased it explained to me that i could use it whenever i wanted. I am an artist and i have sold some of my designs before and i had photoshop and over 35 original pieces of artwork on the computer when they asked me to move them so her husband could format the drive, i purchased a mb stick but it wasnt enough so i explained i would by another one, but he erased all the artwork anyway. Over 150 hrs of time and 35 pieces of art, and im acually good not cruddy kid stuff. Can i sue?

  1. You're going to sue your sister?  While you're living with her?

    You've got balls, bud - I'll give you that.

    I don't think you'll win - it's her computer, she gave you notice to remove the stuff, you didn't do so in time.

    The Court would rule against you.


  2. Sure you can sue... you can sue for anything... the question is will you win and in this case is it worth it?

  3. Well, that sucks.  You have to prove it was on there and you have to prove that they either negligently or intentionally erased.  Then you have to prove damages.  What were they really worth?  If you can't prove that, you might only win $1 or nothing at all.

    Also, you still have to live there right?  Yeah, it sucks, but do you think it would be good to sue someone you have to live with?

  4. You did not mention anything about paying rent. Therefore, I assume that you don't pay rent, utilities, groceries or contribute to the household expenses in any way--- yet you want to sue the hand that feeds you.  

    Right after you get done filing that law suit -- pack up your suit case because it's a pretty safe bet that you will be finding someone else to mooch off of.

    If you are under 18 - you can't sue. Minors can't sue. You would have to have your parent or legal guardian do it.

    Since you were using a computer you don't own -- it would have been a good idea to have had all your art backed up any way. You should have been doing that all along. So, take it as a lesson learned and keep a pile mb sticks handy and save each piece of art after you complete it.

    Sometimes cr@p happens and you don't get paid for it.
