There is no reason why you can't use it.  I would say it's not banned.

If you're on about Yu-Gi-Oh! World Championship 2008 for the DS, then no, you can't, as the cards (apart from The Light Ruler) aren't in the game.

EDIT: He very specifically said, 'Yu-Gi-Oh! World Championship 08.'  I think once again, I might be the only person NOT missing the point here <_<
