Can landlords increase rent anytime after the end of the lease if renter and landlord did not renew the lease?

landlord and tenant forgot to renew the lease.

10 days notice is enough in VA?

If the tenant want to move out, does the tenant need to give 2 months notice?

  1. Simply put, YES!!!

    I am renting a apartment and I have not finished a lease instead I am buying a house and breaking my lease, BUT the manger told me that after my lease was up I would be considered a month-to-month tendant and at anytime my rent could be raised with out notice.

    If you have no lease you should only need to give a week or two of notice.


  2. WITHOUT a written lease, statutory lease, regulated by law, takes over with ONE exception...if the original lease you signed has a "holdover" clause.

    If you have been paying month to month, then everything is done with a 30 day notice.

    The landlord had to give you a 30-day notice to vacate or raise the rent, and all you owe him is the same.

  3. Yes - if there is no contract

    The original contract should state the terms after the lease period.  If it does not you are on a day to day contract.

    Most contracts define what the increase is after the contractual period, and the number of days of notification to cancel the new month to month term.

    In any case the terms are written in the contract if they exist.  If they are not written they do not exist.

  4. After the lease expires you are considered a month to month tenant and you would need to give one month notice to vacate.

  5. You would be on a month to month and they could raise the rent every month I suppose.  It wouldn't be good for business but I don't know of any laws (my state anyway) that would stop this.
