i signed a 3 year lease for a new business and for whatever reason he has become quite angry or mad at me. and we are thinking he is going to try and kick us out once we get open. i really dont know what ive done to him, but i asked him for money that he owes me and he said some nasty things then hung up on me. the last thing i want to do is spend the kind of money i did on my business, to find out he is just going to kick us out. before i signed the lease, he was super cool, but since then nothing but attitude and hes quite the jerk actually. i have done nothing but be nice and comply with everything.

  1.     if you have a lease signed.he must also abide by it.it sounds to me like he is pi--ed off because now he thinks he is not charging you enough.some people are never sattisfied.you didnt explain why he owes you money.good luck.

  2. He cannot force you to vacate the premise unless you violate your contract.  For example, of you pay rent on time, have caused no type of disturbance to neighboring business/residences, no damage to the unit, kept up on required maintenance that is your responsibility then you are not violating the contract.

If you are concerned then I'd contact a legal aid which is very inexpensive and they can provide you some guidelines to protect yourself from the landlord.  The landlord also has to adhere to state/county/city laws and if they do not you can pursue legal action against the landlord.

  3. Getting an attorney is expensive, but not getting one could be more expensive.  Ask around to other businesspeople and get a recommendation for a good attorney.

I had an attorney tell me to let him take the case *and* get a court order, so then, if you follow the court order, you can do no wrong.

My attorney also helped me to realize what points that I had were valid or not and it takes a load off of your mind to have an attorney handling the case for you.

  4. he cant kick you out just like that. You have rights.

  5. Generally, with commercial leases, the tenant is required to pay for any alterations, maintenance or upgrades.

  6. You can only be kicked out if you violate the terms of your lease (unless there is a clause in the lease stating otherwise).
