Can my Child custody and reduced child support ?

My finance has a 3 year old daughter, he was with the mother for five years and has been broken up with her since the his daughter was about one.

She doesn’t not work and hasn’t in years she lives with her father. She is out every night, and drink and smoke with her daughter around. She pose on the internet nearly naked. She took my finance to court before they were broken up. She recently had another child and took that man to court when she was engaged and living with him and the baby was nothing but 6 weeks old. Since the spring she has had numerous men. She lives my fiancé’s daughter with her friends that do not look after her well at all. For example they take her camping and get drunk and let her play by fires. They posted pictures of this type of stuff on there myspace. We have repeated tried to enroll her in preschool and daycare because her mother say she has no one to watch her to find a job.

We want to get custody of her, we usually have her from Thursday night to that following Tuesday afternoon every other week. We are constantly buying her cloths and other things like hygiene products because the cloths she comes with are extremely to small.

This girl and I have also had our problems she started emailing right after we got engaged and her older sister started emailing saying she was going to “jump me”.

I have also been accused of things like talking to the father of her other child when I don’t know him at all.

I want to know what do we need to take custody, and support our evidence?

And should be wait a couple months to build up more proof she is unfit?

And also when my fiancé was 18 he receive a misdemeanor for stole property, he got 3 years probation no time served will that effect him he is 26 now?

I may not be a lawyer but it doesn't take an idiot to realize this little girl is in a bad environment. You have to prove that she is an unfit mother. get pictures of these acts.. if necessary get written statements from people who can prove her wrong doings (for them to be legal they have to be notarized).Do you know if she is paying rent? (I can almost guarantee she'll say she is!) It can take about a month at least to bring the custody case to court again so be prepares, she will also make him look unfit. He has to make himself look good in the process. Do you guys have a suitable household? Steady jobs? Stuff like that. I don't think the mis. when he was younger will affect it, but he has to convince the judge he's changed not me... I hope everything goes well and works in your favor... Good Luck :-)

A child is helpless to their surroundings and it's the responsibility of the adults (i.e., parent(s), family member(s)) to come to the rescue.

Regardless of your fiancée's past the responsibility today is the child. Let legal counsel advise and help build your case.  But action should be taken by daylight!

I'm not sure what state or country you reside but most have plenty of resources. Check your county clerks office (typically in City Hall) or the Family Service Agency in your area. You should be able to obtain a list of legal attorneys.

Oh my god, please talk to a lawyer right now. Her mother is letting her "friends" get her preschool-aged child drunk and posting pictures of it on the Internet? How much more proof do you need that this woman is unfit as a human being, let alone a mother?

Oh my god. How is it that people like this are even allowed to reproduce?
