Read your policy most of them do state they can write for the most cost effective part available.

They absolutely have the right to use used and aftermarket parts to get your car back to preloss condition.

No you usually do not have a right to OEM parts

Normally the policy (or 'contract') that you sign states they do have the right to look for compatible used parts.  If their unable to locate these, if economical OEM.

If an 2001 Buick needed a rear bumper, their going to look for that year, make, model bumper (refurbished of course).  It costs a lot more and really doesn't make sense to put a 2007-2008 bumper on a 2001 vehicle.
