Can my boss be held liable for not informing us of canceled insurance?

i recently had a doctor appt,and later found out that we are no longer covered under that insurance.i informed my employer to find out if she will pay the bill,and her reply was not possitive. she dosn't seem to think she should be responsible.

  1. good employment law question.

    by not telling you the insurance was canceled [was ti replaced?], you employer has arguably changed the employment agreement without your knowledge or consent.  A good attorney would argue that doing so is so one sided as to be illegal as against public policy.

    it would follow that the employer or new insurer is liable for the coverage you used to have.

    of course, your alternative may be to quit -- since you now know that they changed the terms of employment with telling you.

    while there may be specifics in some countries/states/provinces, you didn't tell you where you are, now did you?  [tsk, tsk]


  2. I would imagine the answer might vary from state to state. That said, I would agree she would need to inform you if your insurance were terminated. And I expect an attorney would agree as well. Whether it's worth that pursuit, well, you have to make that call.
