Can my boyfriend go to jail for us having cyber s*x?

he is 18 and im 17 and my parents took my cell phone and we are afraid they will look at past txts and find the onces with our s*x talk. can he go to jail for that.

  1. It is not out of the realm of possibility of him going to jail if a complaint is sworn.

    The charges could be:

    Corrupting a minor

    Luring for the purpose of sexual interference of a minor on the internet

    It all depends on the statutes that are are in place in your current state. And seeing he is in a different state now than you, it would become a federal case as the state lines have been crossed.

    The only ones that could get him into trouble are YOU or your parents at this time. And jail is a real pssibility as the courts are not taking cases like trhis lightly anymore, especially in the current light of the 13 year old girl in TX who ran away to be with her boyfriend in Mexico.  She never knew he was 25.

  4. First, it depends on the state.  In some states, such as Texas, the age of consent is 17 so he could come and have real s*x with you without any legal trouble.

    Second, some states have laws regarding enticement of a child online, through text messages, etc.  Again, this depends on the state.  But enforcement of such laws tend to be directed at sexual predators going after younger females, and it usually needs evidence demonstrating an intended meeting and actions that support the idea that the predator was following through with meeting.

    Third, a prosecutor isn't going to want a case regarding two people, 17 and 18, where a consensual online or text conversation regarding explicit sexual behavior occurred.  Even if you two had intercourse, it would still be a tough case in many areas because the jury would laugh, assuming it even got to a jury.

    In my estimation you are safe.  But it truly depends on the laws in your state and the stupidity of the district attorney or prosecutor in your county.

    In most states, seventeen is the consent age for s*x.

    However, let's say that it's not.  As long as your parents cannot prove intent to actually have s*x with you and these are only harmless texts, then there isn't anything they can do.  If you two took things further from this and in your state it's not legal for you to say yes, then he's facing charges.
