Can my employe give me a final written warning for somethin i did 9 months ago?

  1. When did they find out about it? Maybe they were just trying to make up their mind and maybe since then you have done something small and they have just had it with you.

  3. Did you have a formal 'disciplinary investigation' followed by a disciplinary hearing? Were you advised in advance to attend a hearing and why? Were you offered a representative? Did you see copies of minutes etc?

    The direct answer is yes they can IF all of the above have been followed.

    If they have not been followed you should send an appeals letter stating that you did not have the above , did not agree and would like to appeal the decision.

If you did 'something wrong' 9 months ago and they told you they expected better from you over the next nine months, for example - better timekeeper, better attendance etc - if you have not kept to that agreement I believe they can give you a final warning now.  However, if this is not what has happened then they cannot just backdate a final warning for that period of time.

  8. It depends on the circumstances. More to the point, did they follow the correct disciplinary procedure? Go to the Business Link website to see if they did. You might like to go to your local Citizens Advise Bureau (CAB) to get some advice.
