can my ex husband stop me from moving from this state to another state due to a transfer. I am not married but we have been living together for 9 years. please help. my boyfriend is being transfered and i want my kids to go with me

  1. He can try.  It gets expensive to track you down with attorneys.  If you have in your divorce settlement that the children must see dad on X number of days, or that you cannot take them out of state without his permission, then you two can play legal games.

    This is always so sad when two adults cannot discuss problems like relocation, and make arrangements between themselves about their children.... the only people who come out ahead on things like this are the two attorneys....ever know a poor one?  Me neither.

  3. If there is no clause in your divorce decree putting limitations on where you can move then no, he cannot stop you.

    It is up to you to explain to the children why you are moving so far away from their father, though.  

    Compromising on visition will be a little more difficult, too.

  4. if you do not have a custody agreement wave to him as you drive away no you do not.  If you do then you need proof that you are bettering yourselves by moving.  That is how mine is set up I cannot move out of state (and him too) unless it improves my income and my daughters well being.

  5. Your EX husband can NOT legally stop you from moving, BUT a judge can. You need to look at your divorce decree or consult an attorney about legal disputes between divorced parents of dependent children.

  6. No, if you have custody of your children, you can move anywhere you want to. If he has partial custody, than you may have to talk to your lawyer about it.  

  7. if you have full custody of your kids all you have to do is give him 30 days notice that you are moving but no he cant stop you  

  8. yes he can most child cases have a claus that states you can not move out of state without the other parent's consent.. talk to your attorney before you move
