Can my fiancee stay with me while we are sending the required forms for the K1 visa ?

My fiancee is US citizen, we are going to get married soon, She wants to send the required forms for the fiance visa but It's so hard for us to stay apart during the process, because it may takes more than 6 months. Is there any way that we can apply for the K1 visa while she is not in the US and is living with me ?

  1. She needs a US address  and also need to show tax stubs to and US tax returns to prove she can support you in the US.

  2. You can't file a fiancee visa or K-1 if you are going to be married while it is in process.If you are going to be married first, you should be filing a K-3 or spouse visa. After she filed the petition, she can stay with you while it is in process.She can even attend the interview with you. However, she needs to have a US residence/ address. If she will be out of the country long and that means no source of income for her, she might encounter problem in the income requirement for the Affidavit of Support.But if you have it covered already, yes, she may stay with you while it is in process.
