we have a fire claim and heres the thing my fiances ex wife did not want our home at all and she wanted nothing to do with it. well the court ordered that he get it and she has no right to any of the claims in the divorce decree and she seems to think that she gets part of the money just because her name is on the mortgage but like i said its stated in the divorce decree that she isnt entitled to anything and besides she has not paid on this home or anything. she is trying to get all of our info sent to her and shes trying to intercept everything. please help we dont know what to do! however we have hired a legal public adjuster and they say that she has no rights to the claim , the home, or the property!

  1. Her name being on the mortgage doesn't give her any right to take anything.  Actually all it does is tie her name up on a loan.  Any attorney that has taken her case is doing it for the money only.  She can take anything.  Use the divorce decree and back her up.  Use your brain and tell her that if she continues to try to get money from your claim she would be defrauding the insurance company and could spend time in jail because of it.  She can also be sued by any business that she obtains personal information about you from.

  2. In then end the only thing she will have is a hefty lawyer's fee....

I would consider hiring a lawyer to protect your interests.....good luck.

  3. She's a classic idiot! Let her spend all she wants on a lawyer, she still gets nothing.

  4. no, she gets nothing from that

  5. talk to your lawyer about fraud charges against her. that should stop her for now when she is facing jail on fraud. you can call creditors have a pin put on your accounts so that anyone should try they have to be asked a number of questions only you would know. most compaines now have fruad protection services free of charge.

  6. I am not sure but I do not think she would have any claim. That money is for damages and the repairs. If she was not married at the time of the loss I do not believe she has any legal right to the claim even if her name is on the papers yet. Her name should have been removed when the divorce was final. The divorce decree should spell out the right as to the property. That is more than likely what is going to determin her rights.Good Luck.

  7. She is dillusional.  When she lost all claims to the house, she lost claim of anything there after.  Tell her to back up, she lost her rights in the court settlement
