Can my husband children get a visitors visa to visit us in the US?

I am a United States citizen by birth and my husband 2 children live in a Foreign country can they get a visitor's visa to visit us in Texas?I can file for them but they are doing so well in school we didn't want to upset their schooling.

  1. All they can do is take their chances and apply. No one can predict the outcome of an application for a visa.

    If your husband came to the U.S. with an immigrant visa, that might act as a good indicator.

    If your husband came to the U.S. with a visitors visa and adjusted status to permanent resident, that might act as a bad indicator. The reason why is that it may make it appear that you want to do for the children (adjust status) what your husband did.

    If the visa officer thinks you are going to try to circumvent the orderly process of immigrant visa issuance, i.e., bring the kids to the U.S. as visitors and then petition for them, the kids aren't going to get a visa.
