Question:

Can my husband collect unemployment if the owner of his hotel sells the hotel without his knowledge?

Actually, he is the manager of said hotel and he found the ad online, but he hasn't said anything to the owner yet. The owner has had people come in and out to look at the hotel, and my husband has asked him why and he lies and tells him the people are just looking at the hotel to see how to run one. So I need to know if he can collect unemployment if he sells it and can he just add his employees to the sale? Is that even legal? My husband doesn't have a contract with him and it is a small hotel. We are also in Pennsylvania, if that helps. This really hurts my husband's feelings. He helped open the hotel and is the only manager and does all of the work. He has also been there for almost 4 years. Thanks for your answers in advance.

  1. If you husband loses his job through no fault of his, he should be able to collect unemployment. But, just because the ownership changes hands, that does not mean he will lose his job. The new owners may keep the current staff.

    If he quits or is fired for his conduct, then he may lose his unemployment benefits.


  2. Regardless of the law, there are tons of people who are in violation, and enforcement for the victims is a joke.  Perhaps you should consult the Pennsylvania Department of Labor regulations as they apply to the kind of employee your husband is.

    The owner of a property has zero obligation to inform employees of efforts to sell the business.  The first they need to know, under the law, is when there are new owners actually being new owners.

    Typically at that point, if you want to keep the job under the new ownership, you have to fill out a bunch of new employment paperwork, as if you were being hired for the fist time.

    In some geographic areas, in some industries, the government requires that there be advance notice given if some place of employment is to be closed.  This may or may not apply to your husband.

  3. if he gets fired due to restructuring or organization then he could.  he can't collect simply because the hotel is sold.  there is a good possibility that he could still stay on and be employed by the new owners.

    and tell you husband not to take business dealings so personally.  letting staff know about a possible sale could cause problems with work productivity.  its quite common that information won't be released unless a sale actually goes though.  

  4. uh...if he sells and lets your husband go, he can collect. If he quits because he thinks he will lose a job in a sale or because he is unhappy, he won't be collecting.

    Wait it out; sharpen the resume; and jobhunt.  

  5. As inconsiderate your husbands employer is being, its not illegal. In a sale, he can sell the business and either lay off your husband (hense, get unemployment) or his job can continue with the new employer.
