Can my husband get a license in South Carolina if he isn't technically a U.S. citizen?

First of all my husband is a German citizen. He originally came to the U.S. in 2005 on a student visa to attend college and will graduate Dec '08. Since he has been here we have gotten married, he has obtained a social security number, and pays taxes on all money he works for. He has recently gotten a job where he is required to have a SC driver's license. He never got a license even overseas because they rely so much on public transportation. I tried to look on the website for the DMV but cant get a clear answer as to if he can obtain a license and if so what process do we need to go through? Thanks!

  1. If he is here legally it shouldn't be a problem. There are tons of foreign undergrad and gradute students with cars.


  2. Possible. He'll need a birth certificate; and on presenting a German one, he'll need some type of proof he is here legally; foreign students can have American licenses as long as they are here legally.  

  3. If he is an illegal alien, he might not be able to.  You did not say what his immigration status was - just glossed over that detail.

    If he has never had a driver's license, he will be required to take a birth certificate to get his license, which will probably say he was born in Germany.  That detail will probably lead to all the immigration questions and you didn't even say if he had a green card or anything.

    If not, his application for a driver's license, may lead to his deportation.

    That's why so many illegal aliens do not have licenses and insurance.

  4. Yes, he can get one. simply go to the DMV and get the forms and fill them in and wait in interminable lines like everyone else.
