Question:

Can my landlord charge me to paint the apartment after I move out even though it has not been painted in 2yrs?

I thought it was California law that a landlord is required to pay for painting of an apartment after move out if it has been over 2 years since the last paint job. What if I have lived their for 19 months and the previous tenant had been their for 6 months; should the landlord still pay for all the painting after I move out? No paining was done between the time I rented and the previous tenant rented.

  1. In california, he can only charge for damages within the scope of normal wear and tear. If the paint was deteriorated only due to normal every day use, he is wrongfully withholding money, or his charge is invalid. If he's withholding a deposit for this, you are entitled to three times the wrongfully withheld part and reasonable attorney fees.

    Talk to an attorney asap on this one.

  3. You would have to prove that no painting was done before you moved in now onto your question CA law states if you in a place for 2 or more years the landlord cant charge you for paint.  However in your case you were there 19 months they can only charge you for a 1/4 of the cost to repaint.

  4. A normal paint job should last well beyond 2 years.

    The landlord can and should charge you if you've damaged the paint in any way....ie, scuff marks, dirt, nail holes, dents.
