i just moved into this place i paid a week rent and gave my landlord the deposit but i decided to leave after 2days of staying there. can my landlord keep my deposit if i never signed a lease?

  1. When you don't abide by the rules, expect to lose your deposit.  Without a lease you are on a month to month basis and are required to give notice.  Without notice you are without deposit return.


  2. He can, and you owe rent for next month as well.   Without a lease you default to real estate law, which requires you give a 30 day notice.

  3. Unfortunately, yes!  Doesn't matter if you signed a lease or not, you obviously had some sort of verbal agreement, and paying a deposit to him show intent to commence a lease.

If you want this legal, you will need to inform the landlord in writing that you need your deposit back but you will have to pay the 2 days you stayed there.  Try Consumer Protection - or Tenant Rights -- it will scare the landlord and would likely return your money.

You should have signed the lease!  The lease protects you more than him.  You left yourself naked.  He can evict you at anytime with a thirty day notice.  He can keep your deposit, and still come back and sue you for unpaid rent, or any damages, or expenses he incures because of your occupancy.
