Can my mom petition my daughter as immigrant? i'm not a citizen yet.?

i was out of the country for 2 years so my status is back to zero. i'm not a citizen yet, i'm still a green card holder. if i petition for my wife & daughter it will take more or less 5-10 years since visa number is not immediately available. that's very long. as an alternative, it is possible/allowed for my mom to petition for my daughter as immigrant. any help is appreciated. thank you in advance.

  1. Grandparents, even if they are citizens, have no status to petition for a grandchild.  Since you made a mess of your status and are back to zero, why don't you just go back to live in your own country?  You are harming your daughter -- she needs a father a lot more than she needs an immigration sponsor.


  2. Not possible, your mother is ineligible to petition your daughter or your wife.

    You will have file for them yourself, the quicker to do it, the sooner the day will arrive and furthermore, once you do become a citizen, you can upgrade the petition and a visa number will become available and current for them both.

    It is just a waiting game I'm afraid; there are many people in your predicament, it is just the sad reality which they face.
