Can my neighbor put a fence ON the property line in Harrison County Indiana.?

I live in Harrison county Indiana USA

My neighbor is putting up a fence on the property line. Is this legal? Also he has already said he is not going to maintain the fence. Doesn't he have to maintain it?

  1. Check your local laws.

    In Arizona it has to be on your property.

    In Las Vegas also.

    In California also.


  2. No, it's not legal. I believe the law is it has to be 3 feet inside their property, so that they are responsible for mowing and weedeating on both sides of the fence so you don't have to.  

  3. As` long as he doesn't build it on your property. of course he can. He could also ask you to pay for half of the fence. If you don't want to chip in, then you have no say as to whether the fence is maintained once built.

  4. From a lawyer.  If he puts it on the line you need to sue him to remove it.  This is called a Tresspass to Try Title suit.   If you don't force him to remove it, after a period of years your land that the neighbor took will actually become his under the law of adverse possession.
