Can my parents claim me on income tax if i'll be 23?

I'm going to be 23 by the time 08 income tax time comes around...

My parents are going to claim my son, can they claim me too if i didnt work at all in 2008?

  1. yes - because you are still a dependent.  Normally the reason they can't claim you is because you made some type of income. It's pretty hard to say you supported someone that made 20K a year, but if that person made 3k a year or nothing at all - they were depending on someone.  


  2. If you make under $3500 gross in 2008, and your parents provide over half of your support, yes they can claim you.

From the information you provied, Yes your parents can claim you as a dependent.  To be sure though visit the IRS web site at www.irs.gov and look at Publication 17.  Publication 17 is in the forms section, left side near the top.  There are 5 dependent tests that must be met for some one to claim a dependent.  If you can answer yes to the five tests then your parents can claim you.

  5. Case 1.  You are not a student.

    If you:

    1.  Lived with your parents all of 2008

    2.  Had in come subject to tax of less than $3,400

    3.  Your parents provided over half of your support

    Then your parents can claim you as a qualifying relative.  Your fiance cannot claim you if he did not provide over half of your support.

    If your child:

    1.  Lived with your parents for over half the year.

    2.  Did not provide over half of his own support

    3.  Neither parent is going to claim the grandchild

    Then your parents may claim the grandchild.   You or the father of your child, if he lives with the child, would have priority to claim the child.  

    Case 2:  You are a student.

    If you (or your child):

    1.  Lived with your parents for more than six months

    2.  Did not provide over half of your own support

    Then your parents can claim you (or your child) as a qualifying child.  They may get a bigger refund by doing this.

    you have a kid and you didn't work... Time to step up and be a parent get a job support yourself and your child. Stop taking advantage of your parentss

    I doubt you qualify for this though, because if you were hitting the books instead of the salami, you wouldnt have popped out a kid.

    Hey, if you pop out some more kids, then you can give them more deductions next year.

    Then your parents can pay you $4000 to watch the kids, and write that p**p off.  It would be helpful if you used your fiances address.
