Question:

Can my parents travel to US on their B2 visa if they apply for immigration (green card) now?

Hi,

My parents got their B2 (10 yr multiple-entry) visa in 2006 and my mom visited US after that. Now if they (my parents) file for immigration in F4 category, i.e. (Family-based/Brother Sister) as my mom's brother is a US Citizen, then would they be able to travel to US on B2 visa after that? And if they can travel, then can they renew their B2 visa after 10 yr period while their immigration application is still pending, as of now the F4 category backlog is 10-11 yrs? Please Advise !

  1. If all that was filed was the I-130 petition by the sponsoring family member then -- So long as they appreciate and respect the rules in regard to their B2 visa (foreign unabandoned residence, no working, fixed length of trips, maintaining residence in their home country) then they should be able to continue to travel on their current B2 visa.

    If they filed I-485 Adjustment papers then no they may not travel on their B2 visas.
