Can my wife take me out of the Medical Insurance?

We are separated for almost 4 months but we did not file for divorce yet. Today I found out that she took me out of the medical insurance 3 months ago?...and she did not even tell me! She has insurance from her empoyer and she could keep me for free. Legaly, can she do that?

  1. Absolutely. It is insurance through her employer.  She is under no legal obligation to keep you insured.  However, it was pretty low of her to not at least tell you she was doing it.  What if you had an emergency and needed medical care?  But she is legally entitled to do it.


  2. Legally she can take you off the inusrance at anytime. It was not right of her to not make you aware of these changes. I would get your own health insurance asap, so you will not be subject to any preexisting conditions.

  4. Yes.   So don't get sick until she puts you back on the insurance or you can afford your own insurance.

  5. she can legally do that, at this point.  you need a legal separation agreement that says she has to keep you on the insurance.  at this point, if you don't have one of those--then she hasn't done anything illegal.

  6. Of course she can; it's her insurance.
