Can one Sue if a doctor failed to diagnose A Leg Fractures

A couple of doctors told me that I had no leg fractures. Until I found out I did becasue of A MRI. The first doctor told me I should be full weight bearing. And he said I had no fractures. Another doctor told me I should get physical therapy and that I had no fractures. Thanks

  1. If you had a fracture, and it was only picked up by MRI, it probably was a stress fracture or something so small it's basically meaningless.  Was there any harm to you when you had full weight bearing?  It doesn't sounds like it.  Anyways, talk to a lawyer, and once you get turned down because you suit is unlikely to win, you'll have your answer.


  2. i would say you could sue go get some legal advice from a medical negligence lawyer.

  3. you really don't remember if you had leg fractures or not ? in that case, you need another kind of doctor.

  4. Best to speak to an attorney in your area. If a normal X-Ray did not show the fracture but an MRI did it makes me a bit suspicious if the fracture existed at the time of the initial X-Ray or if it was such a hairline fracture that it could not be detected on a reguar X-Ray. Since two doctors arrived at the same diagnosis it might make proving medical negligence a bit more difficult if not almost impossible. Even if the two doctors misdiagnosed you in order to establish negligence you will have to proved damage and that they were in some way providing you with substandard care. To you it may seem that they were but as I read your posting in my mind there is some doubt if they were truly negligent in their care to you.

    In order to get the answer you need it is best to have your facts evaluated by an attorney who knows the laws that pertaine to your area and who could better advise you.

Fractures are sometimes not visible on standard x-rays...especially early on.  The next question would be: Did your doctor go outside the standard of reasonable and acceptable care?  Would other doctors in the same position have come up with the same answer?  It sounds like they did, and acted within the standard.  

    HOWEVER, did you continue to have complaints for a signficant amount of time that were out of proportion with your alleged injury? Did they fail to act on that? How much time elapsed before an MRI was finally ordered?  Secondly, did you experience any abnormal outcomes based on the care that was given to you?  These are all questions that need to be considered.

    If it was only a couple weeks later before the MRI was ordered and if your long term outcome isn't any different than if they would have caught it early, then most likely, no you have no case. Especially if the problem was also evaluated by the second doctor who came to the same conclusion.

    If you continued to see this doctor for weeks on end with persistent pain without any answers, and if he violated the standard of care, AND you suffered more injury that resulted in financial or permanent physical disadvantage, then yes you could possibly have a case.
