Can one be charged in one state for for violations/probation from another state?

A friend of mine is on probabtion for possession as well as having 2 speeding tickets and a traffic violaton that he has not paid for (and missed the court date, thus lists him having a suspended license). All of this is in Maryland. I now just found out that he recently turned himself in for another charge of possession and skipping court date which he had a warrant out for him in Virginia. When he went to turn himself in to the VA Police, they say that they checked his records twice and found nothing else... so I know they must not have checked Maryland records. My question is.... why??? If they checked MD records, they would see that he already is on probation and has other violations. Is this because of some law about out of state tickets or something? I'm tempted to call the VA police to tell them to look up the MD records just so he can finally get all this past him. Suggestions?

  1. What Virginia did was run a standard BCI check ( which is state specific only) to see if anything is outstanding in their state.

    Before he is released from the VA jail, they will also run an NCIC check ( Federal ) which will show any and all warrents in all states. At that point, VA will contact  MD to let them know he is being currently held. MD will have to answer whether they want to pick up or extradite him before VA can release.

    If MD states they want him, VA can hold him for 72 hours on the warrent. If MD fails to show up in that 72 hour period, he will be released.

    PS....if it helps at all, when booking someone in, it is very normal to only run a BCI check at that moment. It gets hectic and busy and the NCIC takes a little more time. The secondary check is usually done within a day from booking.

  2. no , it has more the do with the computer systems.  theres and most state only do the state they are in.. NOW if he was wanted for murder or something just as bad that it would have gone state to state and when the pulle up his record it would have come up.. but because it is consided minor it does not come up in different states.

  3. It depends on if he is in violation of his Maryland probation case.  If he is not currently in violation then there is not much that they can do about it.  They could place a hold on him, but more than likely he'll be released.

    If his new charges occurred recently, his Maryland probation agent may not know about his new charges yet.  Once he/she gets a hit about the new charges a violation of probation warrant will be submitted to the court for his MD probation case.  You can always try to contact his probation officer in Maryland and give them a heads up so they can run a NCIC records check on him and submit a warrant for your friend asap.

    It really all depends on if he's in violation of his probation currently and there is already an active warrant.  Maryland is fairly "nice" to their probationers/parolees, so he'll probably get continued on probation even with the new possession charges in VA.
