The government does this all the time with known drug dealers.  The only solution is an encrypted phone.

All SMS messages may be intercepted.  Some systems may be harder to compromise than others, however, it is a mistake to believe that any SMS system or provider is secure.

The bottom line is that NO form of telecommunication- especially wireless- is secure.  Even an encrypted device can be decrypted if someone wants to eavesdrop badly enough.
