Question:

Can our foster kids who have a greencard but no Mexican passport fly into Mexico?

We cannot get another updated passport because the Mexican consulate does not recognize that the parental relationship is severed unless we get it marked on their Mexican birth certificate! I read that maybe they could go into Mexico with a (Matricula?) Right now the only documentation we have is their birth certificates and Green Cards.

  1. Mexican nationals do not need a passort to travel Overland into (not by air) to mexico.  The children will need a passport to get back into the US.  There are also requirements by the airlines that you prove your Guardianship of the children.  

    However the SRE (the ministry of foregien affairs) does say that :

    11. ¿Qué requisitos adicionales debo presentar si soy tutor de mi hijo mayor de edad?

    Deberá entregar copia certificada de la resolución judicial que lo designa como tutor y del auto por el cual causó ejecutoria.

    In english this says "what additional requirements do I need to present if I am the leagal guardian of a minor? You must turn in a certified copy of the order designating you are the legal guardian of the child(ren).

Yes they may  See site below and read Very carefully.  The 1st paragraph under "Information-normal passports" says they can.  Then the 2nd paragraph seems to contradict that and says that anyone departing from the U.S must have a passport.  However, you need to click on the blue letters...then you get a page that explains that there are exceptions...persons with a valid, current U.S. green card may travel without a current passport.  Be sure you carry legal papers showing you have custody of the children.

    Edit:  Just saw the first answer...Mexican nationals CAN fly to and from mexico without a passport...I know people who have done it.  If they are green card holders in the u.S. , they may.  Here is a direct quote from the u.S. state dep't:

    legal permanent residents in possession of their I-551 Permanent Resident card may board flights to the U.S. from Mexico.

    "legal permanent residents in possession of their I-551 Permanent Resident card may board flights to the U.S. from Mexico."  This is a direct quote from the state dep't website.  See  3rd site below and read under "Entry Requirements."  It is the last sentence.  Also, see the last site and read the last sentence in the 4th paragraph.  These sites clearly state that legal permanent residents of the U.S. may re-enter the U.S. with their green card.  this is a difficult topic.  I know in the past I even gave the wrong anser, but after more research, I found that green card holders may re-enter the U.S. with just their green card.  And Mexican citizens may enter Mexico with their Mexican birth certificate or Matricula.
