20 year old's auto is in their name. 20 year old is/was a college student

  3. If the car is in dad's name....yes.

    Legally dad is the owner of the car. Both dad and son will be sued.

    If dad has assets, those are at risk.

  9. owner of the car can be sued for damages, relationship to driver is irrelevant.  it's up to a jury whether they're liable.

    but parents are not responsible for actions of adult offspring.
