  1. There has to be a court order to garnish wages. If the payday loan company so chooses to pursue the legal fee's associated with attaining a garnishment then it could happen before is goes to collections. Most often it's easier for them to write-off the loss and sell the loan to collections. The collection agency certainly has the option to pursue a judgment for a garnishment also. So long as the statue of limitations aren't up on the debt. If successful the legal fee's will be tacked on to your garnishment. If they are going to sue or garnish you, you will either be served or mailed court date information. Often whether or not they will pursue civil litigation depends on if the amount the stand to gain is substantially more than the time and cost it will take them to gain a judgement in their favor.

  2. A defaulted payday loan doesn't necessarily have to go to collections first. If the loan is defaulted on, we go to the court house, file paperwork , sue, get a judgement, garnish your wages. Some larger companies might send to an outside collector, but we take it straight to court and sue. Good Luck!
