Question:

Can person record a phone conversation with out informing the caller that they are being recorded?

Wondering if Montana has a law regarding this or is there a federal law that relates to this.

  1. you can do anything you want.

    the next thing is, what can you do with the recordings....

    Some states allow single party notification, some states require an audible beep on the line... but it is fun to watch when a caller (telemarketer) says one thing, later denies it, but you play the tape back for them:)


  2. It depends on where the call is being placed to.

    If the call is Intrastate (within one state), then it depends on the current laws of the state you reside in.

    Montana requires two-party notification.  Both people must be aware of the call being recorded.
