  1. The elements of the RICO laws and sedition statutes are all that are needed for a law enforcement agency to attempt to prove a crime was committed.  For example, if a statute states a person knowingly and willingly engaged in conduct which was organized with three or more participants in a concerted effort to commit a criminal offense to the benefit of one or more person in the state(s) of ______, then regardless of the title of the law, as long as the elements are met you have a conviction.

Now, if the law is unconstitutional, that needs to be raised with the trial court prior to trial, and if there ultimately is a conviction, to the appellate courts.

  2. RICO took down the Bottoms Boys (Shreveport, LA).  There is documentation online.

    Google it.

  3. Give it time I'm sure some top DA or judge will give it a shot. I don't see why the don't use the anti terrorist laws on them. After all aren't they just terrorist groups.

I'd like to see them use RICO against the government. Extortion, kidnapping, murder, racketeering. Yeah I'd say they all apply to the government.

  4. RICO IS A FEDERAL CRIME SPREE. I FEEL THE SAME, THERE SHOULD BE RICO LAWS THAT APPLY TO GANGS WHO HAVE A MULTISTATE JURISDICTIONAL GROUPING.

In discussions with many attorneys, they say it is easier to get the individual off the street state wide  instead of Federal?

  5. As long as they have some sort of structure yes.
