Can some one sue if you hit them on a surfboard?

ya if your at a beach with no surf zone can some one sue you if you hit them

  3. If you are at an open beach, and you hit someone with a surfboard, they are able to sue you. You can get sued for anything. However, the circumstances make a big difference. On an open beach, the bathers assume a degree of risk sharing the water with surfers. Now, if you hit them with a board, because you didn't use a leash, you failed to use reasonable caution....You could Lose!

    If you hit a bather with a board at a no-surf beach, you shouldn't have been there to begin with. Of course they can sue you (like we said, almost anybody can sure for almost anything), however, you are likely to lose BIG TIME. There is not much of a defense for doing a hazardous activity in an area where its prohibited.

    Now, are there too D#@n many no-surf zones? I say yes, but for the people who make money from non-surfing tourists, you'll get a big argument.

  5. Unfortunately, there are too many 'Ambulance Chaser" attorneys in practice in every state looking for their 35/40% of the cut. Yes, the surfer may be sued, but the plantiff (swimmer) has the burden of proof (has to prove), via witnesses, video, or otherwise that you were the surfer that struck them. Attorneys will always look for a settlement before taking a case to trial (easy money). You do not have to make any statements to anyone, including law enforcement. So don't discuss it with anybody. If you are served with a suit, consult with an attorney. Don't talk to anyone else, but your attorney from this point on. No one!

  6. Yes they can! They can sue you for looking at them. anything. They would not win i am guessing and they would be pretty stupid to sue for such a dumb thing.
