It was established in the midst of a revolution against a strong British government, where people felt their best interests were served better by state governments.  So the Con-federation was a VOLUNTARY ASSOCIATION of cooperation, not a real government.  It could only advise the states, but had power only to direct the war effort- not to fund it, tax, or make laws.
