Question:

Can someone appear in court for you?

My father passed away and my sister is taking everyone to court. The papers say if I don't appear then I will not be entitled to anything. It isn't possible for me to attend because it is out of state and some other factors. My brother is going, would he be able to be my representation?

  1. you REALLY need to ask a lawyer.


  2. It HAS to be an attorney - no one else can represent you.

  3. Only an attorney can represent you.  Anyone else who attempts it commits "the unlicensed practice of law," or whatever it is called where the estate is being probated.  

    If you cannot afford your own attorney and trust your brother, you can write a detailed letter to the judge explaining your situation and ask your brother to bring the letter to the judge's attention at the hearing.  I don't recommend that, but you can try it.

  4. wow your sister is taking everyone to court after your father died?! That doesn't sound very nice of her.  I agree with everyone else you have to have an attorney to represent you.  But ask around considering you live out of state maybe there's something that could be done.  I really don't have much experience in this.  Good luck and sorry about your dad

  6. seek a lawyer on this..if it is important enough for you to go then you need to go and represent yourself..court should be more important than whatever you are doing that day..
