  1. written statement with your signature can be used against you in a court of law and you can be questioned about it

  2. Yeah they can say whatever they want but they already signed a statement saying they were the driver so they are now stuck being the driver.

  3. You wrote: "...one admits to driving and the other being a passenger, admission by written statements ..."

At the point where the driver and passenger admit in writing that they were the parties involved, it's difficult to imagine them being taken very seriously when they tell a different story after things get more serious.

The passenger should stay with what was said on the original written statement. They will be saying, "I told you the truth then, and I'm telling you the truth now."

The driver, on the other hand, will have a hard time selling the prosecutor on letting him change his story, since he originally admitted being the driver, and only changed his story after the victim died.

I'd say the passenger needs to testify for the prosecution and the passenger will probably walk away from any sort of conviction. The driver will probably not be so lucky.

  4. Call that perjury and lying to a police officer and falisying an accident report and expect both of you (passenger and driver) to face a stiff

sentence but the driver would get the worst of this mess.

You lied and so did your passenger and so the judge will probably give you both some extra jail time to make up for this serious offense.

Next time tell the truth and shame the devil.
