Question:

Can someone park there recovery truck (5.6tons unloaded)on a residential street overnight continuosly?

i have a neighbour that keeps on parking his recovery truck on the road outside my house .all the residents are completely fed up as the council or police won't do anything about it. we've tried leaving polite notes but he started threatening people . and has also said he would damage or remove our cars if we park on the road so he can't.

  1. check you bylaws, you may have legal recourse if the bylaws of your community have restrictions.

    If he is threatening you and your neighbors, get the police involved. they have an obligation to protect, and if there are threats, you need to call chief of police to get action. Try to get it on video if possible.

    Also, you have every right to park on the street in front of your house.  If this individual tows or damages you vehicle so he can park there, you again have legal recourse. if he tows your vehicle, that is the same as grand theft auto.


  2. Sound's to me like you have a Bully on you hands! If your local police and city council wont do any thing about it, you need to research the local ordinances and find a legal way to do it. Maybe start up a petition and get all the neighbors to sign it and take it to city hall. Sorta sounds like the guy has some ties with the city fathers. If so, and your in a small town, there's probably not much that is going to be done. Good Luck!

  3. It actually depends on the State and or local municipality that you live in. A lot of residential neighborhoods have petitioned their local governments to ban overnight parking of commercial motor vehicles in those residential only areas.

  4. The laws vary between states and county's, A call to the local police would answer your question.
