  1. Way back in in 1903, we leased the land for a naval base from Cuba.  That lease still exists today.

  2. we basically own it, forget about leasing, how long is the lease anyway? the usa wont give it back!

  3. It's a long standing lease agreement since 1903. The terms of the lease state that for the lease to be void/cancelled, both parties must agree to terminate the lease. Cuba have wanted the lease terminated for decades now, but the US still want it to continue.

Therefore as both nations don't agree to terminate the lease continues (providing US still pay their rent of course), and Guantanamo is in US hands.

  4. we have a lease.  actually is only been a prison a short while.  thank you president for that atrocity.  mostly it's been a usmc combat base.  somewhat like in korea.  our lease predates the communist revolution.

The United States assumed territorial control over Guantánamo Bay under the 1903 Cuban-American Treaty, which granted the United States a perpetual lease of the area without the Cuban Government reacting. The current Cuban government considers the U.S. presence in Guantánamo to be illegal, arguing that the Cuban-American Treaty violates Article 52 of the 1969 Vienna Convention on the Law of Treaties, which declares a treaty void if its conclusion has been procured by the threat or use of force in violation of international law.

  5. There was lease in 1903 that was renegotiated in 1934. That Treaty is still in good standing. I don't recall the lease amount but it has a great escape clause. Both Parties have to agree on leaving. Either can block the others request simply by saying no or no thank you.

The Castro administration made the mistake of cashing the first check sent after he came to power. That simple act is legal acceptance of the 1934 agreement. The checks are still sent annually as required but they no longer cash them.

Proof that lawyers can do you good at times!

It was chosen for it's isolation from our mainland. Not much chance any of their buddies are gonna show up to try anything.

Anyone making claims that the prisoners are being held in violation of The Geneva Conventions is only proving they have never read either version. Now that you know there is more than one try a simple search and read up.

       It's own law?

       Existing law?

       Martial law?

       Military law

    SSG US Army 73-82

  6. More to the point - how come Americans are encouraged to go to communist China on business and/or for a holiday and yet are dissuaded from going ever to communist Cuba for any reason.

Guantanamo Bay is owned by the US Marines - it's their property.

  7. Because what is going on there is away from prying eyes.

  8. The 1903 'treaty' was signed by an utterly corrupt that was prepared to sell out its own sovereign territories to another state. It was done under duress although the cash under the table helped. It's just another example of the ability of the US to be able to utterly corrupt a regime, as happened with the Shah, Marcos, Pinochet, etc. Such treaties should never hold.
