Can someone tell me if I'm right?

My brother took the NYC regents and he got a score of (brace yourselves) a 40 on the Math A (idiot, I know :P)

He thinks that he's passed the regents....I'm pretty sure a grade of 40 is failing, and if it isn't it SHOULD be. He thinks he passed because "they would have sent a letter if he failed". Am I right that he failed? Or is he right (doubtful)

  1. The Math A exam consists of 30 multiple choice questions, each worth two points, plus nine extended answer questions variously worth 2, 3, or 4 points. The maximum possible score is 84, but conversion to a 100-point scale is done by a test-specific conversion chart rather than a strict percentage basis. On the June 2007 exam, for example, a student needed to earn only 35 of those 84 points (41.7%) to earn a passing grade of 65. On today’s January 2008 exam, the cutoff dropped again, to 34 out of 84. In other words, 40.5% is now the new 65%.

    So yes he passed.
