Can someone with temporary US residency get a student visa to the UK?

I have my temporary US residency, so I'm supposed to live in the US for at least 6 months and 1 day out of the year (or so I'm told). Would it be possible for me to get a student visa to the UK and go to college over there without losing my residency?

  1. This business about 6 months and one day is a fallacy, pure hogwash.

    However, to answer your question, you could apply for a student visa for the UK if you wanted. If it was granted, you could attend school in the UK.

    Many lawful permanent residents attend college outside the U.S., and the government takes the viewpoint that as long as they intend to resume their residence in the U.S. after graduation, there's no problem with studying outside the U.S.

    If you plan to be absent from the U.S. for more than a year, apply for a reentry permit. They're valid for two years. Use a form I-131 to apply.

    If you plan to be outside the U.S. for more than two years without any interruption, you may need to apply for another reentry permit, if possible, or a SB-1 immigrant visa a few months before returning to the U.S. to live.
