This may sound like a silly question but. If you live in Canada, and are married and have not worked for 2 years and have not done taxes so can be filed as a dependant an one party do taxes and file it before or after it has been done to claim without the other party knowing? Both parties have not done taxes in 2 years

  1. This is confusing.  Are you asking whether one person can claim another as dependent without said dependent knowing?  I would suppose so, provided all the conditions are met.  You'd be claiming that person using the caregiver amount, perhaps?

However, if the 'dependent' later files their own tax, you could be guilty of fraud if the original claim is found not to be valid.

  2. If you're the dependant and didn't have any income, you really won't get much of a return at all. If you are wanting to do this because you feel that your spouse would get a good refund, then encourage him/her to file and also claim the spousal amount for you. If you and your spouse are not on good terms and you are doing this to get his refund deposited into a previously set up account that you control, then it is fraud. I suppose that taxes CAN be done without the other person knowing but it's not legal and it will catch up with you.

  3. Kinda,  Once you declare the other party as a dependent CRA will check to make sure the numbers entered for the dependent match the numbers you entered.  If the dependent has not yet filed they will receive a letter with a request to file
