I know that in many companies you are technically not considered an active employee when on leave and are usually barred from even being on the premises, but does anyone know if these rules differ for teachers?

  1. Should be able to if you desire.  Read through your contract to see if there is anything at all written about that particular circumstance.

  2. Bottom line and up front, the teacher can be active in school issues when they are on maternity leave.  A lawsuit would be in order if there was an attempt at "banning" them from such activities.  Even in the companies that you know about that consider you "technically" not an active employee when on leave, again, if taken through legal channels, wouldn't hold up.  Now, I understand "blacklisting", "blackballing", and "shunning", but legally, there is nothing to keep employees from participation simply because they are on leave of any kind, including maternity.  If you know of such a practice, I have a lawyer friend that would be most interested in learning more.
