  1. Since they are a bunch of lawyers, I suppose they would find a loophole that would allow them to.  


  2. No. Medical records are generally available only with a signed release, court order or subpoena.  The ABA does not normally do such things.  Individual lawyers, however, can.

In what context?  The American Bar Association is an entirely voluntary professional organization for lawyers, not a body with any kind of regulatory authority, so I have difficulty thinking of any justification they would have for obtaining private medical records...or why they would want to.

  4. Lawyers can dig up medical records, so yes.
