Can the Court order you to take a pregnancy test in a custody battle in MA?

I live in Mass and my Girlfriend is in a custody battle with her mom. Her mom has her 2 year old daughter because her mom hates me. But her mom wants her to take a pregnancy test. My Girlfriend said no so now her mom said she is going to have the court order one.

  1. If she can get the court to order one, yes you have to take it.   But the court needs reasons and knows what it is acceptably allowed to be asked of the public.   It just does not do things willy nilly.  


  2. Her mom doesn't have her two year old daughter because she hates you. She has custody because the court deemed that it would be safer for the child to b with her instead of your girlfriend (whatever that reason might be)

    But yeah I think they could. I knew a girl who had her 2 daughters taken from her by CYS, the case worker had a feeling she was pregnant ordered a pregnancy test and when she gave birth they took that baby too.

    Sad situation for all


  3. If there is a question of paternity, they can order a test, and the normally do.  Her mom hating you has ZERO to do with why she has custody.  Your g/f must have had the child taken away by the court due to her actions.

  4. The court can make you do pretty much whatever they deem necessary as long it follows their code of ethics.

  5. I really doubt its worth the court fees and lawyers to do that, if your girlfriend is over 18 to be honest she really can't.  Also the mom of your girl friend has to prove that your girl friend can not take care of that child, if your the father you have every right to see that child.
